Data Owner Application Form

Pursuant to the Constitution of the Republic of Turkey and the Law on the Protection of Personal Data No. 6698 (“Law”), real persons may request the protection of personal data related to them, information about personal data related to them, access to their personal data, correction or deletion of their personal data. Regarding the personal and sensitive personal data obtained by the personal data owners (our company);

• To learn whether his/her personal data is processed or not, to request information if processed,
• To find out whether his/her personal data is used for his/her purpose,
• To find out who the third parties to whom the data are transferred at home or abroad, if any,
• If the personal data is processed incompletely or incorrectly, requesting correction thereof and, in this extent, requesting notification of the transaction performed to the third persons to whom the personal data have been transferred,
• To request the destruction of the processed data in the event that the reasons requiring the processing of personal data are eliminated, to request the notification of these requests to the third parties to whom the data are transferred, if any,
• Objection to the emergence of a result against you by analyzing your processed data exclusively through automated systems,
• They have the right to claim compensation in case they suffer loss due to unlawful processing.

Personal data owners do not have any right of claim under the provisions of the Law in the presence of the following reasons;

• Provided that personal data does not violate national defense, national security, public security, public order, economic security, privacy of private life or personal rights or constitute a crime, processed for artistic, historical, literary or scientific purposes or within the scope of freedom of expression,
• Processing the personal data for the purposes of investigation, planning and statistics by anonymizing with official statistics
• Process of the personal data within the scope of preventive, protective and intelligence activities carried out by public institutions and organisations entrusted and authorised by law to ensure national defence, national security, public safety, public order or economic security,
• Processing the personal data by judicial or enforcement authorities in relation to the investigation, proceedings, litigation or execution procedures.

In accordance with the Law, it is not possible for personal data owners to assert their rights under the Law, except to claim compensation for damages in the presence of the following numbers and situations;

• Processing of the personal data is necessary for prevention of crime or investigation of a crime,
• Process of the personal data revealed to the public by the data owner herself/himself,
• Process of the personal data is necessary for the execution of supervisory or regulatory duties and disciplinary investigation or prosecution by the public institutions and organisations and professional organisations in the nature of public institutions, which are authorised by law,
• Process of the personal data required for protecting economic and financial interest of the State with regard to the budgetary, tax related and financial issues

In the event that personal data owners submit their requests regarding their personal data in accordance with the Law, as the data controller, they will ensure that this request is concluded free of charge as a rule within 30 (thirty) days at the latest. In the event that the request requires an additional cost, the fee in the tariff determined by the Board shall be reflected to the applicant. In order to ensure the security of the data, our company may request information from the applicant in order to determine whether the applicant is the owner of the personal data subject to the application or may ask questions to the personal data owner in order to finalize the request, and the personal data owner must answer these questions in writing. The application of the personal data owner may be rejected by our company by explaining the reasons. If the request in the application is accepted, our company fulfills the requirement of the request.

3. APPLICATION METHOD TO BE FOLLOWED BY DATA OWNERS

Personal data owners are obliged to make their applications to our company in Turkish by the following methods. Personal data owners may submit their requests regarding the above-mentioned rights to our company using the application form below. In order to convey the subjects on which the personal data owner requests information, it is sufficient for them to mark the fields under the heading of “Preference” and, if necessary, to provide an explanation of their request and the information and documents supporting their request.

The personal data owner may send his/her application in writing or by using the registered electronic mail (Kep) address, secure electronic signature, mobile signature or the electronic mail address previously notified by the applicant to the data controller and registered in the data controller’s system to the following addresses.
